1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of https://contractordiesel.com (the "Site") and your purchase of fuel delivery services from Contractor Diesel LLC ("we," "us," or "our"). By using the Site or requesting a delivery, you agree to these Terms. If you do not agree, please do not use the Site.
2. Services
We provide on-site delivery of on-road diesel, off-road (dyed) diesel, and home heating oil, along with related services such as tank set-ups, truck and machine fueling, emergency fueling, and winter storm fueling. Service availability, delivery windows, and minimum order quantities may vary and are confirmed when we accept your request.
3. Delivery Requests & Confirmation
Submitting the online form is a request, not a confirmed order. A delivery is scheduled only after we confirm it by phone, text, or email. We may decline or reschedule requests due to weather, access conditions, supply, or safety concerns. You agree to provide accurate delivery information and safe, lawful access to the fill location.
4. Pricing & Payment
Fuel prices fluctuate with market conditions. The applicable price, fees, and payment terms are those quoted or agreed at the time your delivery is confirmed. Applicable taxes are added where required by law. Past-due balances may be subject to late charges and suspension of service.
5. Dyed (Off-Road) Diesel — Legal Use
Dyed diesel is untaxed and may be used only for off-road purposes permitted by federal and state law. By ordering dyed diesel, you represent that it will be used only in lawful off-road applications. You are solely responsible for any penalties arising from misuse of dyed fuel.
6. Customer Equipment & Site Conditions
You are responsible for ensuring that tanks, equipment, and fill points are in safe, code-compliant working condition and clearly identified. We may refuse to fill equipment that appears unsafe, damaged, or non-compliant. You are responsible for informing us of tank capacity; we are not liable for issues caused by inaccurate information, defective equipment, or pre-existing conditions (including leaks) not caused by our negligence.
7. Cancellations
Please notify us as early as possible to cancel or change a confirmed delivery. Deliveries already dispatched may be subject to a trip or restocking charge.
8. Limitation of Liability
To the maximum extent permitted by law, Contractor Diesel LLC's total liability arising out of any delivery or use of the Site is limited to the amount you paid for the delivery at issue. We are not liable for indirect, incidental, or consequential damages, including downtime, lost profits, or equipment damage not caused by our negligence. Nothing in these Terms limits liability that cannot be limited by law.
9. Website Use & Intellectual Property
The Site's content, logos, and images are the property of Contractor Diesel LLC and may not be reproduced without permission. You agree not to misuse the Site, attempt to disrupt it, or submit false or fraudulent delivery requests.
10. Text Messaging & Privacy
SMS communications are governed by our SMS Terms. Our collection and use of personal information is described in our Privacy Policy.
11. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles. Any disputes shall be brought in the state or federal courts located in Massachusetts.
12. Changes to These Terms
We may update these Terms from time to time. The current version will be posted on this page with a revised effective date; continued use of the Site or our services constitutes acceptance.
